Terms of Service

These Terms of Service explain the rules for using FolioSpace, including our website, app, portfolio builder, templates, AI-based features, paid plans, account tools, publishing features, and related services.

1. Acceptance of these Terms

By accessing or using FolioSpace, you agree to these Terms of Service. If you do not agree to these Terms, you may not use FolioSpace.

These Terms apply to all users of FolioSpace, including users who create accounts, build portfolios, upload media, publish pages, use AI-based features, connect third-party accounts, or purchase paid plans.

When you use FolioSpace, you also agree to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

2. Who can use FolioSpace

You may use FolioSpace only if you are legally allowed to enter into these Terms and use online services in your country. If you are under the age required by applicable law to use online services without parental consent, you may only use FolioSpace with permission from a parent or legal guardian.

If you use FolioSpace on behalf of a company, organization, team, or other legal entity, you confirm that you have authority to accept these Terms on behalf of that entity.

3. Accounts and security

You agree to provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that happens under your account.

  • You must not share access to your account in a way that violates these Terms or weakens account security.
  • You must notify us if you believe your account has been accessed without permission.
  • We may suspend or restrict access if we believe your account is being used fraudulently, abusively, unlawfully, or in a way that could harm FolioSpace or other users.

4. Plans, subscriptions, and payments

FolioSpace may offer free and paid plans. Paid plans may include additional limits, templates, custom fonts, extra pages, team collaboration, GitHub export, branding removal, media uploads, or other premium features.

Billing

If you purchase a paid plan, you authorize us and our payment provider, Stripe, to charge the payment method you provide for applicable fees, taxes, renewals, upgrades, or other charges connected to your selected plan.

Renewals

Subscriptions may renew automatically unless cancelled before the renewal date. You are responsible for managing your subscription and cancelling before renewal if you no longer want the paid plan.

Refunds

Unless required by law or stated otherwise at the time of purchase, fees are generally non-refundable once a billing period has started. We may choose to provide refunds, credits, or exceptions at our discretion.

Plan changes

We may change plan features, prices, usage limits, or billing terms from time to time. If a change materially affects an active paid subscription, we will provide notice where required by law or where reasonably practical.

5. Your content and uploads

FolioSpace lets you upload, create, edit, generate, store, and publish content such as portfolio pages, project descriptions, links, images, videos, audio, files, templates, and other materials.

You keep ownership of the content you create or upload to FolioSpace. By using FolioSpace, you grant us a limited license to host, store, copy, process, display, publish, transmit, and otherwise use your content only as needed to provide, maintain, protect, and improve the Services.

  • You are responsible for the content you upload, publish, or generate.
  • You must have the rights needed to use and publish your content through FolioSpace.
  • You must not upload content that infringes intellectual property rights, violates privacy rights, breaks the law, or violates these Terms.
  • You understand that published portfolio pages may be visible to other people depending on your settings and how you share them.

6. Published portfolios and public content

When you publish a portfolio, project, page, or site through FolioSpace, that content may become publicly accessible. You are responsible for reviewing your published content before sharing it.

We may remove, restrict, unpublish, or disable access to content if we believe it violates these Terms, infringes rights, creates security risks, causes technical issues, or exposes FolioSpace or users to legal risk.

If you delete content or close your account, some copies may remain temporarily in backups, caches, logs, or systems where immediate deletion is not technically practical.

7. AI-based features

FolioSpace may include AI-based features that help users generate, improve, summarize, organize, translate, analyze, or design portfolio-related content. These features may use prompts, uploaded materials, profile details, project information, or other inputs you provide.

  • AI outputs may be inaccurate, incomplete, similar to content generated for other users, or unsuitable for your intended use.
  • You are responsible for reviewing AI-generated content before using, publishing, or relying on it.
  • You should not submit sensitive personal information, confidential business information, or content you do not have permission to use unless the feature clearly requires it and you are comfortable doing so.
  • We may use third-party AI providers to provide AI-based features, as explained in our Privacy Policy.

We do not guarantee that AI-generated content will be unique, legally safe, accurate, or free from third-party rights claims.

8. Acceptable use

You agree not to misuse FolioSpace or help anyone else misuse it.

  • Do not use FolioSpace for illegal, harmful, abusive, fraudulent, deceptive, or spam-related activity.
  • Do not upload malware, malicious code, harmful scripts, phishing content, or content intended to compromise systems or users.
  • Do not attempt to bypass usage limits, security controls, rate limits, account restrictions, or payment requirements.
  • Do not scrape, copy, crawl, reverse engineer, overload, disrupt, or interfere with FolioSpace except where allowed by law.
  • Do not impersonate others or misrepresent your identity, affiliation, qualifications, projects, or ownership of content.
  • Do not upload or publish content that violates intellectual property rights, privacy rights, publicity rights, or other legal rights.
  • Do not use FolioSpace to harass, threaten, exploit, or harm others.

9. Third-party services

FolioSpace may integrate with or rely on third-party services, including payment processors, authentication providers, analytics providers, hosting providers, uptime monitoring tools, AI platforms, GitHub, Google OAuth 2.0, Stripe, Cloudflare, Better Stack, and other infrastructure or support providers.

Third-party services may have their own terms, privacy policies, rules, fees, or availability limits. We are not responsible for third-party services, and your use of them may be governed by separate agreements with those providers.

If you connect FolioSpace to a third-party account, you authorize us to access and use information from that account as needed to provide the connected feature.

10. FolioSpace ownership and intellectual property

FolioSpace, including its software, interface, design, branding, templates, systems, workflows, documentation, icons, names, logos, and other materials, is owned by Websitecode or its licensors and is protected by intellectual property laws.

These Terms do not give you ownership of FolioSpace or its underlying technology. You may not copy, resell, license, reproduce, modify, distribute, or create competing services from FolioSpace except where expressly allowed by us or applicable law.

You may use FolioSpace templates and tools to create your own portfolio content, subject to these Terms and the limits of your plan.

11. Service availability and changes

We aim to keep FolioSpace reliable, but we do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

  • We may update, modify, limit, suspend, replace, or remove features at any time.
  • We may perform maintenance, upgrades, security work, or emergency fixes that affect access.
  • We may set or change limits for storage, uploads, bandwidth, pages, AI usage, exports, teams, or other features.

We are not responsible for losses caused by downtime, bugs, data loss, service interruptions, third-party outages, or changes to the Services, except where the law says otherwise.

12. Suspension and termination

You may stop using FolioSpace at any time.

We may suspend, restrict, or terminate your account or access to FolioSpace if we believe you have violated these Terms, failed to pay applicable fees, created risk for FolioSpace or users, violated the law, or used the Services in a way that could harm the platform.

After termination, your right to use FolioSpace ends. Some sections of these Terms will continue to apply where necessary, including payment obligations, content licenses needed for completed actions, disclaimers, liability limits, dispute terms, and ownership rights.

13. Disclaimers

FolioSpace is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that FolioSpace will meet your needs, that your portfolio will achieve any particular result, that AI outputs will be accurate or unique, or that uploaded or published content will never be lost, unavailable, or removed.

14. Limitation of liability

To the fullest extent permitted by law, FolioSpace, Websitecode, and our owners, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business, goodwill, or portfolio opportunities.

To the fullest extent permitted by law, our total liability for any claim related to FolioSpace or these Terms will be limited to the amount you paid to FolioSpace for the Services during the three months before the event giving rise to the claim, or 50 EUR if you have not paid anything.

Nothing in these Terms limits liability that cannot legally be limited, including liability for intentional misconduct or other liability that applicable law does not allow us to exclude.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FolioSpace, Websitecode, and our owners, employees, contractors, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of FolioSpace, your content, your violation of these Terms, or your violation of another person's rights.

16. Governing law and disputes

These Terms are governed by the laws of Denmark, unless mandatory consumer protection laws in your country require otherwise.

If a dispute arises, you agree to contact us first so we can try to resolve the issue informally. If the dispute cannot be resolved informally, it may be handled by the courts or authorities with jurisdiction under applicable law.

17. Changes to these Terms

We may update these Terms from time to time. When we make changes, we will update the effective date above and may notify users through FolioSpace, by email, or by other reasonable means where required or appropriate.

If you continue using FolioSpace after updated Terms take effect, you agree to the updated Terms. If you do not agree to the updated Terms, you should stop using FolioSpace.
